2. Scope of These Terms
These Terms apply to purchases made by consumers through the Site. A consumer is an individual acting wholly or mainly for purposes outside their trade, business, craft or profession.
Nothing in these Terms excludes or limits any statutory rights available to consumers under applicable UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3. Eligibility and Customer Information
You must be at least 18 years old and legally capable of entering into a contract to place an order through the Site.
You agree to provide accurate, complete and current information when placing an order. You are responsible for checking your billing address, delivery address, email address and other order information before confirming your purchase.
If you become aware of an error after placing an order, you should contact us immediately at support@hearble-uk.com. We cannot guarantee that an order can be changed after it has been processed or dispatched.
4. Products
We take reasonable care to ensure that product descriptions, specifications, photographs and prices displayed on the Site are accurate.
Product images are illustrative. Minor differences in colour, appearance or packaging may occur because of screen settings, manufacturing updates or product improvements.
The essential characteristics, intended purpose, contents and compatibility requirements of each product are stated on the relevant product page or in the instructions supplied with the product.
Products are offered subject to availability. We may withdraw or modify a product before an order is accepted.
5. Hearing Products and Health Information
Hearble products must only be used for the purposes described on the relevant product page and in the instructions supplied with the product.
Information provided on the Site is intended for general product information only. It does not constitute medical advice, diagnosis or treatment and is not a substitute for advice from a qualified audiologist, doctor or other healthcare professional.
You should seek prompt professional medical advice if you experience sudden or rapidly worsening hearing loss, hearing loss affecting only one ear, ear pain, discharge, dizziness, injury, significant tinnitus or any other concerning symptom.
You must read and follow all instructions, warnings, contraindications, cleaning guidance and safety information supplied with the product.
The regulatory classification of a product depends on its intended purpose and applicable law. Nothing in these Terms excludes or limits any product-safety, conformity, registration, marking or post-market obligation that applies under the UK Medical Devices Regulations 2002 or any other applicable legislation.
6. Orders and Contract Formation
Products displayed on the Site constitute an invitation to place an order and not a binding offer by us.
To place an order, you must select the products, provide the requested information, choose a delivery method, review the total price and confirm your obligation to pay.
After you place an order, we will send an acknowledgement email. This acknowledgement confirms that we have received the order but does not necessarily mean that the order has been accepted.
A binding contract is formed when we send an order confirmation or dispatch confirmation confirming our acceptance of the order.
We may refuse or cancel an order before acceptance where:
- The product is unavailable
- Payment cannot be authorised
- The price or product information contains an obvious error
- The delivery address is outside an available delivery area
- We reasonably suspect fraud, misuse or unauthorised activity
- We cannot lawfully supply the product to the destination
If payment has already been taken for an order that we cannot accept, we will refund the amount paid without undue delay.
7. Prices, Taxes and Additional Charges
Prices are displayed in pounds sterling (GBP) and include applicable taxes where required by law, unless clearly stated otherwise.
Delivery costs and any other mandatory charges are displayed before you confirm the order.
You will not be charged for optional extras unless you have expressly selected and agreed to them.
If customs duties, import taxes or carrier handling fees may be payable separately, this information must be clearly disclosed before the order is placed. You will not be responsible for additional charges that we were legally required to disclose but failed to disclose before the contract was concluded.
We may change product prices at any time, but a price change will not affect an order that we have already accepted.
8. Payment
Available payment methods are displayed during checkout. Payments are processed securely by Shopify Payments and any other payment provider displayed at checkout.
You confirm that you are authorised to use the selected payment method. We may conduct payment-verification and fraud-prevention checks before accepting an order.
Full payment-card details are processed by the relevant payment provider and are not directly stored by BAPTISTES CORPORATION.
9. Delivery
Available delivery locations, costs and estimated delivery times are described in our Shipping Policy and displayed during checkout.
Unless a different delivery period has been expressly agreed, goods will be delivered without undue delay and no later than 30 days after the contract is concluded.
Delivery times are estimates unless expressly identified as guaranteed. If delivery is materially delayed, you may have the right to set an additional reasonable deadline or cancel the contract in accordance with applicable consumer law.
Responsibility for the goods remains with us until they are delivered to you or to a person identified by you to receive them, unless you independently arrange a carrier that we did not offer.
10. Right to Cancel
Subject to the statutory exceptions, consumers purchasing online generally have the right to cancel an order without giving a reason within 14 days after the day on which the goods are received.
If an order contains multiple products delivered separately, the cancellation period normally begins on the day after the final product is received.
To exercise the right to cancel, you must inform us of your decision through a clear statement before the cancellation period expires. You may email support@hearble-uk.com or use the model cancellation form at the end of these Terms.
You must return the goods without undue delay and no later than 14 days after informing us that you wish to cancel.
Unless we have agreed otherwise or the goods are faulty, you are responsible for the direct cost of returning goods following a change-of-mind cancellation.
You may inspect goods only to the extent reasonably necessary to establish their nature, characteristics and functioning. We may reduce the refund to reflect a loss in value caused by handling beyond what would reasonably be permitted in a physical shop.
11. Sealed Health and Hygiene Products
The statutory cancellation right may not apply to sealed goods that are not suitable for return for health-protection or hygiene reasons once they have been unsealed, provided that this exception was clearly identified before purchase.
This exception may apply to products or components intended for insertion into, or direct contact with, the ear where their hygiene seal has been broken.
This exception does not affect your rights where a product is faulty, unsafe, damaged, misdescribed or otherwise does not conform to the contract.
12. Returns Procedure
Before sending a product back, please contact customer service at support@hearble-uk.com. We will provide the applicable return address and return instructions.
This prior-contact procedure is intended to ensure that the return is sent to the correct location. It does not remove, delay or restrict any statutory right to cancel or return goods.
Unless otherwise instructed, products should be returned using a tracked delivery method. Customers should retain proof of postage until the return and refund have been completed.
Detailed return conditions are available in our Returns and Refunds Policy.
13. Refunds Following Cancellation
Where you validly cancel an order, we will refund the price paid and the cost of the least expensive standard delivery option offered by us.
If you selected a more expensive delivery method, we are not required to refund the additional cost above the least expensive standard delivery option.
We may withhold the refund until we receive the goods or you provide evidence that they have been returned, whichever occurs first.
Refunds will be issued without undue delay and no later than 14 days after we receive the returned goods or evidence that they have been returned.
Unless otherwise agreed, the refund will be made using the original payment method and without a refund fee.
14. Consumer Rights for Faulty Goods
Under the Consumer Rights Act 2015, goods must be:
- Of satisfactory quality
- Fit for their usual purpose
- Fit for any particular purpose made known to us before purchase where you relied on our expertise
- As described
- Installed correctly where installation forms part of the contract
If goods do not conform to these requirements, you may be entitled to statutory remedies, including the short-term right to reject within 30 days, repair or replacement and, in certain circumstances, a price reduction or final right to reject.
These statutory rights are separate from and are not limited by any manufacturer’s warranty or commercial guarantee.
15. Faulty, Damaged or Incorrect Products
If you receive a product that is faulty, damaged, unsafe, incomplete or different from what you ordered, please contact support@hearble-uk.com as soon as reasonably possible.
Please provide your order number, a description of the issue and, where reasonably possible, photographs or videos showing the product, packaging and reported issue.
We may ask you to return the product for inspection. Where a product does not conform to the contract, we will bear reasonable return costs and provide the remedy required by applicable consumer law.
16. Commercial Warranty
Any commercial warranty supplied with a product is subject to its stated duration, conditions and exclusions.
A commercial warranty is additional to, and does not replace or restrict, your statutory consumer rights.
17. Acceptable Use of the Site
You must not:
- Use the Site for unlawful, fraudulent or abusive purposes
- Provide false or misleading information
- Attempt to gain unauthorised access to the Site, its servers or customer accounts
- Introduce viruses, malware or other harmful technology
- Interfere with the operation or security of the Site
- Scrape or commercially extract Site content without prior written permission
- Infringe the intellectual-property, privacy or other rights of any person
We may restrict or suspend access where we reasonably believe that these Terms, applicable law or the security of the Site has been breached.
18. Intellectual Property
All content available on the Site, including text, photographs, graphics, logos, videos, product descriptions, software and Site design, is owned by or licensed to BAPTISTES CORPORATION and is protected by applicable intellectual-property laws.
You may use the Site and its content for personal and non-commercial purposes only. Reproduction, distribution, modification, republication or commercial exploitation without prior written permission is prohibited.
19. Third-Party Links
The Site may contain links to third-party websites. These links are provided for information or convenience only and do not necessarily constitute an endorsement.
We do not control third-party websites and are not responsible for their content, availability or privacy practices, except where responsibility cannot lawfully be excluded or where loss is directly caused by our failure to exercise reasonable care and skill.
20. Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Defective products under the Consumer Protection Act 1987
- Breach of rights that cannot be excluded under the Consumer Rights Act 2015
- Any other liability that cannot lawfully be excluded or limited
If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to exercise reasonable care and skill.
We are not responsible for loss that was not reasonably foreseeable when the contract was formed or for business losses where the products were purchased wholly or mainly for personal and non-commercial use.
21. Events Beyond Our Reasonable Control
We are not responsible for delay caused by circumstances beyond our reasonable control. If such an event materially delays performance, we will contact you as soon as reasonably possible and take reasonable steps to minimise the delay.
If there is a risk of substantial delay, you may contact us to cancel the affected order and receive a refund for goods that you have paid for but have not received, subject to applicable law.
22. Privacy and Cookies
Information about how we collect and process personal information is available in our Privacy Policy.
Information about cookies and similar technologies is available through our cookie banner and, where provided, our Cookie Policy.
23. Changes to These Terms
We may update these Terms to reflect changes in applicable law, regulatory requirements, payment methods, delivery arrangements, Site functionality or our business operations.
The Terms applicable to an order are those presented when the order is placed. Later changes will not retrospectively alter an order already accepted by us.
24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
25. No Waiver
If we delay enforcing a provision of these Terms, that delay does not mean that we have waived our right to enforce it later.
26. Governing Law and Disputes
These Terms are governed by applicable UK law.
If you live in the United Kingdom, you may bring proceedings before the courts applicable to the part of the United Kingdom in which you live. You retain all mandatory consumer protections available in your place of residence.
Before starting court proceedings, we encourage you to contact customer service so that we can attempt to resolve the matter directly.
